Slip-and-fall lawsuit filed after incident with peanut shells

Accidents can occur at places of business in New York or anywhere around the country for a variety of reasons. Spills may not have been adequately cleaned up or materials may not have been stored properly, thus causing someone to fall. In other cases, weather conditions may have created hazardous situations. A restaurant in another state is facing a slip-and-fall lawsuit after a patron had an accident involving peanut shells.

A pizzeria has been sued by a woman who slipped and fell on peanut shells as she was walking on a ramp. She claims that the establishment should not have allowed the shells to accumulate on the ramp. Those eating at the restaurant are given peanuts in the shell to enjoy while waiting for their food to arrive. Patrons are free to discard their shells on the floor, according to restaurant officials. While the owners declined to comment specifically on the lawsuit, they indicated that they did not intend to discontinue the practice of having shells on the floors.

The woman is seeking damages of more than $50,000 in her lawsuit. She has stated that her medical bills have exceeded $75,000 to date. The woman required cervical fusion surgery and is still trying to recover from the accident.

slip-and-fall accident can be devastating and may result in serious injury to a victim. When someone has experienced an injury like this, a personal injury lawsuit may be brought against the business where the accident occurred. A business may be found to be negligent in the maintenance or upkeep of its establishment. Likewise, appropriate signage or warnings may be lacking or absent. A New York personal injury attorney can work with clients to evaluate their options and determine the best path forward to achieve a successful outcome in the proceedings.
