New York and many other states around the country must utilize snowplows in the winter months to clear their roads and highways. Certainly, specific training must be given to the drivers of such vehicles to ensure safe operations. Unfortunately, a mistake in the operation of a snowplow led to a catastrophic brain injury and other traumas to a man in another state over two years ago. It was reported recently that this state agreed to settle a lawsuit less than two weeks before the trial was scheduled to begin.
The accident occurred in Feb. 2016 when a man, now 36 years old, was traveling west on a highway when he was struck by an eastbound snowplow. The snowplow driver reportedly did not raise the plow's blade when crossing a nearby bridge. This caused the blade to hit a guard rail, then veer across the center line and strike the man's vehicle.
As a result of the impact, the man suffered a brain bleed, which led to permanent disability with a traumatic brain injury. The crash also caused him to break multiple bones. The state of Iowa settled the lawsuit out of court just before the trial started. The man will receive a settlement of $3.5 million from the state.
A brain injury can severely impact a person's quality of life. If an injury has been caused by the negligence of an individual, a company or government entity, someone may choose to file a personal injury lawsuit. A New York attorney can assist individuals and their families throughout the entire legal process. A successful outcome in a lawsuit can provide compensation for hospital expenses, ongoing therapy costs, lost wages, or pain and suffering.
